Help me if you can, please!

I think the problem is going to be that you didn't agree on a time when the book would be done before he took your pics.

He ordered my book on May 27th, which before the other girl even had her shoot..and she is getting her book tomorrow. That and the lack of communication between him and I is giving me a very uneasy feeling. I should have had my book by now. I have tried calling him and emailing him with no luck. At this point I am stuck with no anniversary gift fro FI and nothing to tell him as to when he should expect it.

For the time being, I would give FI a different gift and save this for a future gift. The photog may have rushed the order on the other girl's book or there may have been an issue with yours that he's working on sorting out.

 

You won't have any legal issues that are actionable in the immediate time frame, because you didn't set a date on when he owed you your free book. With that logic, a court would probably see anything in a reasonable amount of time as being acceptable. In my opinion, a few months would be reasonable for product that you're not paying for. And trying to take it to court will only draw out the process. As far as getting him to fork over the pictures he took of you, it probably would be a lengthy process to first get a court to order that he do so and then get him to comply with said court order.

Does the photographer have an actual brick and mortar studio? My photog does different things with different books so some books take longer than others to come in. She has different book companies she works with, so the time varies. Maybe this is the case.

No, his 'studio' was in his unfinished basement, with proper backdrops/lighting. Then the second shoot was in a hotel room. From what I have gathered the other girl had her shoot on May 30th and is getting her book tomorrow...June 9th. Her shoot was, I THINK, in the studio. Giving her 10 days including 4 weekend days. 6 Days for her to get her book!?!

Is her wedding before yours? That's the only reason I can think of to explain it...? Maybe she was in a rush.

I am the "other" girl. This is a very unfortunate situation and I hope that we both get what we were promised. My shoot was free as well but I was very clear with him as to when I needed the book and he said ok. I have everything in writing. It is not definite that I will get my book on tomorrow as I am still waiting to hear back from him. I leave next week so I hope he responds to my email soon!

Well, when he and I first met, I told him it was for an anniversary gift which was May 5th, but I understood there was no way I could get it by then...he said I should have it soon after that...then many many things keep coming up and still no book. I hope BOTH of us get what we agreed to.....and to make note of to the previous posts....like the TA....I was not aware that her shoot was free as well, so this is not a matter of paying clients vs. non-paying clients.
