I am so sad and upset that Prop 8 passed, which basically states that "marriage is only between a man & a woman".

I talked to my grandmother today and she even said she thought it was totally inappropriate for the state to define marriage as that is a religious issue. My 83 year old grandmother voted NO!!!!! (my other grandmother voted yes so they canceled each other out).

So the court in Norwalk (L.A.) stopped issuing gay marriage licenses today and will resume if told by court order. Napa county stopped as well. Solano County (N. CA) will continue to issue gay marriage licenses until ordered otherwise. I'm not sure where the other counties stand.

 

Someone made a striking point, saying that chickens now have more rights than gay Californians (you know we passed that animal rights measure). It's ludicrous.

 

For couples married during the 'legal' time, the CA Attorney General said the state will fight for their right to remain legal. I expect a lot of lawsuits as this ban is unconstitutional...that's all I know!

too bad, I wish this didn't have to happen, but like it was said earlier maybe this is the situation that will finally bring it to the supreme court.

Marriage is a legal contract, not just a religious term. That being said, many family law issues are governed by state law. Divorce, custody and child support, as well as the requirements for a valid marriage are all based on state law. The U.S. Constitution reserves these rights to the states via the 10th Amendment. I don't know of any case/situation where the issue of marriage has implicated any First Amendment rights.

 

States have the right to determine many things such as capital punishment and restrictions on abortion. These are normally submitted to the population of the state via a referundum. New Jersey recently repealed their capital punishment law and no longer have it as a possible sentence.

 

The Defense of Marriage Act, passed in 1996 and signed by Mr. Bill Clinton, provided that as far as the federal government is concerned, marriage is between a man and a woman. This law has survived numerous constitutional challenges, and appeals to the Supreme Court regarding this law have been rejected by the Court.
